Initial autopsy results indicate that Pormanove did not die from the blows he received during the Kick broadcast. But the case is far from closed:<\/p>\n\n\n\n
Several legal questions arise:<\/p>\n\n\n\n
Can we talk about intentional assault and battery in a group, online harassment, and violation of human dignity?<\/p>\n\n\n\n
What is the responsibility of the Kick platform: is it simply a host or a true content publisher?<\/p>\n\n\n\n
Can internet users who bet money to encourage these humiliations be considered accomplices?<\/p>\n\n\n\n
And, more broadly, what is the responsibility of the public authorities in the face of these abuses?<\/p>\n\n\n\n
The unease persists: can we really consent to being humiliated or beaten live, even under the guise of a paid \u201crole-playing game\u201d? Could the contract between Pormanove and the perpetrators have any legal purpose?<\/p>\n\n\n\n
Finally, a major institutional point: ARCOM, through its President, considered that it did not have jurisdiction on the grounds that Kick was not European. This overlooks the fact that the DSA (Digital Services Act) has extraterritorial effect: it applies to any platform targeting a European audience. ARCOM should therefore have taken action and required the appointment of a representative in France well before this tragedy occurred.<\/p>\n\n\n\n
